1. Eligibility: The Back-to-School Giveaway (the “Sweepstakes”) is open to any legal resident of the fifty (50) United States and District of Columbia who is 18 years of age or older as of date of entry (each, an “Entrant”). Void in the U.S. Territories and where prohibited by law. Internet access is required in order to enter this Sweepstakes. Your standard carrier rates may apply. Individuals who are employees, officers, directors, agents, administrators and representatives of Merry Maids Limited Partnership (the “Sponsor”), Cone Communications and Audrey McClelland of Mom Generations blog (each, an “Administrator”), and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, and the immediate family members (spouses, domestic partners and parents, children and siblings and their spouses or domestic partners, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible to win. All applicable federal, state, and local rules apply. Please note: Any individual who has won a prize in a promotion sponsored by Merry Maids Limited Partnership on Facebook in the twelve (12) months prior to the start of this Sweepstakes, along with any such person’s immediate family or household members who share the same mailing address, is also not eligible. Participation constitutes Entrant’s full and unconditional agreement to these Official Sweepstakes Rules (the “Official Rules”) and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Timing: Sweepstakes begins at 10:00 a.m. Central Daylight Time (“CDT”) on Tuesday, September 8th, 2015, and ends at 12:00 p.m. CDT on Saturday, September 19th, 2015 (the “Entry Period”). The Sponsor’s database clock will be the official timekeeping device for the Sweepstakes Entry Period.
3. How to Enter the Sweepstakes: During the Entry Period, Entrant(s) must like and comment under the specified blog post posted on the Mom Generations page by Saturday, September 19th, 2015, during the Entry Period, as directed in the post. The blog is located at https://momgenerations.com/. Each participant may make a maximum of one (1) entry during the Entry Period. Multiple entries are not permitted. Any attempt by any Entrant to make more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrant’s entries and that Entrant may be disqualified at Administrator’s or Sponsor’s sole discretion. All entries must be received by Administrator during the Entry Period or they will be void.
4. Winner Selection Criteria: Each Entrant selected as a potential winner must comply with all terms and conditions set forth in these Official Rules and winning is contingent upon fulfilling all such requirements.
An Administrator will choose one (1) Entrant’s post from all eligible entries to win one (1) Back-to-School grand prize on Friday, September 25, 2015. Potential winners shall be notified via email on or around Friday, September 25, 2015. Grand Prize winner will receive one (1) Back-to-School Giveaway- one (1) house cleaning from Merry Maids up to $400. Grand Prize maximum retail value (“ARV”) is four hundred dollars ($400.00). Final value of prize will be determined by individual Merry Maids business providing house cleaning services. Odds of winning a prize depend upon the total number of eligible entries received.
These determinations are final and binding with respect to all matters relating to the Sweepstakes. No information regarding entries or judging will be disclosed to any third party not involved in the conduct of the Sweepstakes.
5. Winner Notification. Potential winner will be notified via email on or around Friday, September 25, 2015. Potential winner must respond within the specified timeframe and must complete an Affidavit of Eligibility and Liability Release and Publicity Release within the timeframe specified by Sponsor or Administrator(s) in order to complete all qualifications for the prize. If any potential winner is found to be ineligible or if any potential winner does not comply with the Official Rules, then the potential winner may also be disqualified and an alternate potential prize winner will be determined. If a potential winner cannot be contacted within forty-eight (48) business hours after the first attempt to contact such potential winner, an alternate Entrant will be selected in his or her place from all entries received. Only up to two (2) alternate winner selection(s) will take place for the prize, after which if such winner(s) also do not qualify, the prize will remain unawarded.
6. Prizes: Sweepstakes winner selection will occur on Friday, September 25, 2015. Potential winners shall be notified via email on or around Friday, September 25, 2015. One (1) Grand Prize winner will receive one (1) Back-to-School Giveaway consisting of one (1) house cleaning from Merry Maids valued at up to $400. Prize award is subject to verification of eligibility and compliance with these Official Rules. Individual prize maximum ARV is $400.00. In the event grand prize winner cannot utilize the cleaning service prize as described, in Sponsor’s sole discretion, a VISA gift card valued at four hundred and 00/100 dollars ($400.00) shall be awarded to prize winner instead for cleaning service. Prize winner can only receive one (1) prize. The prize must be redeemed by November 1, 2015.
Prizes and the redemption thereof are subject to terms and conditions specified by Sponsor or Administrator. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Where a prize is awarded in the form of a gift card, voucher or letter (any, a “Voucher”), Sponsor will not be liable for any Voucher that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the Voucher is subject to the terms and conditions specified on the Voucher (or provided with the Voucher) by the company issuing the Voucher. Prizes cannot be transferred, substituted or redeemed for cash, or used in conjunction with any other competition or offer. Sponsor or Administrator reserves the right, in its sole discretion, to substitute and/or modify a prize with a prize of comparable or greater retail value, at its sole discretion. Only one (1) prize is permitted per person and per family or household. The winner must complete an IRS Form W-9 and may receive an IRS Form 1099 for the ARV of the prize. All taxes on prizes and all costs and expenses related to acceptance and use of the prize not specified in these Official Rules as being provided are the sole responsibility of winners. All prize details are at Sponsor’s or Administrator’s sole discretion. Once awarded, Sponsor and Administrators shall have no further obligations to any winner with respect to any prize.
7. Grant of Publicity: By participating in this Sweepstakes, you agree to permit Sponsor and its designees to use your name, city and state address and image or profile photo for advertising, publicity and promotional purposes, in any manner, in any and all media now in existence or hereafter developed, including but not limited to within Sponsor’s websites and on Sponsor’s social media pages, in perpetuity, without compensation (unless prohibited by law) or permission from, or notification to, you, and further agree to execute any specific consent needed or requested by Sponsor or its designees in furtherance of such use. Sweepstakes Entrants may not issue press releases or other publicity in connection with their participation in the Sweepstakes.
8. Privacy Policy: Please see the Sponsor’s privacy policy located at http://www.merrymaids.com/privacy for details of our policy regarding the personal information collected in connection with this Sweepstakes. In the event of a conflict between these Official Rules and the privacy policy, the Privacy Policy shall govern. By clicking agreement to these Official Rules, the Entrant authorizes the use and collection of his or her personal data for the purpose of conducting the Sweepstakes (including publishing winners’ full names and states, counties, provinces, territories or their equivalent, and/or disclosing them to third parties on request in accordance with the winners’ list request procedure set out below) and any other purposes to which you have consented. Sponsor will not sell, share or otherwise disclose information collected in any manner with third parties, other than those parties necessary to fulfill the above purposes.
9. General Conditions: By participating in this Sweepstakes, you agree: (a) to these Official Rules and decisions of Sponsor and Administrators, which shall be final and binding in all respects relating to the Sweepstakes; and (b) to release, waive, discharge, indemnify, defend and hold harmless Sponsor, Administrators, Facebook, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, shareholders, partnership, members, principals, employees, agents, contractors or suppliers (collectively, “Released Parties”) from any claims, actions, injury, liability, loss, or damages of any kind to persons, including injury or death, or property resulting, in whole or in part, directly or indirectly, from participating in this Sweepstakes or any Sweepstakes-related activity or from the acceptance, possession, or use or misuse of the prize (including any travel or other activity related thereto). This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties. Entrants agree that the Released Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Sweepstakes or to any prize awarded.
Released Parties are not responsible for and shall not be liable for: (a) electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries or votes; (b) failed, incomplete, garbled or delayed computer transmissions; late, lost, inaccurate, delayed, stolen, garbled, misdirected or incomplete entries or votes or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes; or (c) any condition caused by events that may cause the Sweepstakes to be disrupted or corrupted. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Sweepstakes. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes or any portion thereof should viruses, bugs or other causes corrupt the administration, security or proper play of the Sweepstakes, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion and, if terminated, to award the prizes from all non-suspect, eligible entries received prior to such action or as otherwise deemed fair and appropriate by Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
10. Governing Law: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the eligible Entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Tennessee, USA, without giving effect to any choice of law or conflict of law rules (Whether of the State of Tennessee, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee.
11. Winners List: For the names of the winners available after September 25, 2015, send a self-addressed, stamped envelope to Back-to-School Giveaway, c/o Merry Maids, 3839 Forest Hill Irene Road, Memphis, TN 38125 by December 31, 2015.
